Terms & Conditions of Use

GravityPilot, a part of Mindfeedfer LLC (“Mindfeedfer,” “we,” “us,” or “our”), grants you a non-exclusive, limited license to use the GravityPilot plugin and other products sold through our website (https://gravitypilot.io) (collectively referred to as the “Products”) in accordance with these Terms & Conditions (the “License”).

Plugin Licensing

GravityPilot is licensed under the GNU General Public License (http://www.gnu.org/licenses/gpl-3.0.txt).

GravityPilot License

GravityPilot offers two licensing options:

  1. Paid: This license includes access to the GravityPilot plugin with all core features and standard support.
  2. Premium Pass: This license includes the GravityPilot plugin, access to the entire template library (including all paid templates for free), and premium support.

When you first purchase a GravityPilot license, you will receive a 12-month subscription for updates and support, known as the “Initial Subscription.” At the end of this Initial Subscription, your subscription for updates and support will be automatically renewed for another 12 months (called a “Renewal Subscription”) unless you take one of the following actions before the renewal date: cancel your subscription by turning off auto-renewal, your payment is unsuccessful, your payment is subject to fraud or chargeback, you request a refund according to Section 7, or GravityPilot cancels or suspends your subscription.

The GravityPilot License will be provided at the level you purchased and according to the descriptions on the pricing page at https://gravitypilot.io/buy/, which may be changed by GravityPilot at any time. You are not allowed to downgrade your GravityPilot License (e.g., from Premium Pass to Paid), but you can upgrade it (e.g., from Paid to Premium Pass) by paying a pro-rated amount based on the remaining days of your subscription. Pro-rated credits are only available for active Initial or Renewal Subscriptions and are not available for canceled or transferred subscriptions.

You are not allowed to use the GravityPilot License on more websites than the maximum allowed for your purchased license level, as stated on the pricing page at https://gravitypilot.io/buy/.

We do not support reselling GravityPilot as part of your own software-as-a-service.

Automatic Upgrades

Currently, automatic upgrades are not available. We are working hard to release this feature in the upcoming 1.0.1 version. This is a top priority for us, and we want to ensure a seamless experience for all our users. In the meantime, if an in-between release or quick patch happens, we will notify customers via email.

Delivery and Access

After we have successfully processed your payment, you will receive access to the “My Account” section on gravitypilot.io. From there, current subscribers can download the latest release of their purchased product through the “Downloads” section. This access may take up to 1 hour to be granted, but usually happens within minutes of placing the order. If you do not receive access after this time period, please contact us.

Ownership

You may not claim intellectual or exclusive ownership rights to any of our Products. All Products are property of GravityPilot, a part of Mindfeedfer LLC. They are provided “as is” without warranty of any kind, expressed or implied. We shall not be liable for any damages, including but not limited to direct, indirect, special, incidental, or consequential damages or losses that occur out of the use or inability to use our Products.

Site Content

All site content, including imagery and documentation that is published on gravitypilot.io, is the property of GravityPilot, a part of Mindfeedfer LLC. Any replicated site content must be authorized in advance. Content from this site shall not be used or exploited for commercial or non-commercial purposes without the prior written consent of GravityPilot.

Refunds

We will be happy to offer a refund within the first 30 days of your purchase. Refund requests must include the date of purchase and the original purchaser’s email address. Requests with incomplete or inaccurate information will be disregarded.

Refunds will only be granted for the original license purchase and do not apply to product upgrades or annual renewals. No partial refunds will be granted for license downgrades, early termination, etc. Refund requests may take up to 15 days to process. Refunds are not guaranteed. All refunds will be granted at the sole discretion of GravityPilot, a part of Mindfeedfer LLC.

Absolutely no refunds will be given after 30 days from the original purchase. Please note that by purchasing the plugin, you agreed to the terms & conditions of use including the Refund Policy.

Support

GravityPilot offers WordPress plugins “as is” and with no implied meaning that they will function exactly as you would like or will be compatible with all third-party components and plugins. We do not offer support via email or otherwise support WordPress or other WordPress plugins we have not developed.

Support is available to customers who are current subscribers of any GravityPilot product. Subscribers can access the support area within the “My Account” section on gravitypilot.io. From there, they can request support directly.

Support and product updates are provided for a term of 1 year from the time of purchase. After 1 year, a new license will need to be purchased in order to continue receiving support and product updates.

The support account is registered to the email address of the original purchaser. The original purchaser (account holder) retains the rights to the account even if the subscription is renewed or upgraded by another party. Only the account holder is permitted to request support or access support resources.

Subscribers cannot distribute, freely give away, or resell their account access. The account is intended to be used on the subscriber’s website(s). Client site usage is permitted in situations where the subscriber maintains an ongoing relationship with the client as a consultant.

Providing GravityPilot as a service or providing GravityPilot as part of a web hosting solution does not constitute an ongoing client/consultant relationship under these terms.

Subscribers are not permitted to re-post support forum content or documentation on any external websites, social media outlets, etc. Posting screen captures of this content is also prohibited. Violation will be grounds for immediate termination of the subscription, and all access to support content and product updates will be discontinued.

Transactional Emails

GravityPilot, a part of Mindfeedfer LLC, may on occasion send you email notifications related to your GravityPilot subscription. These transactional emails may include notification of licensing changes, changes to our terms and conditions, subscription expiration notices, and other transactional emails related to your purchase of GravityPilot. By purchasing GravityPilot, you agree to receive these transactional emails.

Account Suspension

GravityPilot reserves the right, at any time, to modify or discontinue, temporarily or permanently, a subscription with or without notice. If an account is suspended, no refund will be granted.

Warranty

Our plugin is guaranteed to function on a fresh installation of WordPress using the default WordPress theme. We do not guarantee it will function with all third-party plugins, themes, or with all web browsers. We are not responsible for any plugin or theme compatibility conflicts that may occur. It is our policy to support our products as best we can, and we will provide support for third-party plugin conflicts at our discretion or as time allows. We are not responsible for any data loss that may occur as a result of installing this plugin.

Pricing/Billing

We reserve the right to change pricing at any time for any reason. We reserve the right to not honor typographical errors which may cause incorrect pricing on the website.

Arbitration

If you have any issues with us or our Products, we’ll need to sort it out through arbitration, not in court. This means a neutral arbitrator (not a judge or jury) will help us resolve the dispute in Missouri under the American Arbitration Association’s rules. You’ll have to cover your own costs, and we both agree to keep things confidential. Also, you can’t join a class action or similar type of lawsuit; it’s just you and us, one-on-one. By using our Products, you’re saying you agree with this arrangement.

General

The preceding terms & conditions govern the sale of GravityPilot between you, the buyer, and Mindfeedfer LLC. By placing an order with us, you acknowledge that you have read, understood, and agree with our terms & conditions. Please notify us prior to placing an order if you disagree with any of our terms & conditions. We reserve the right to alter these terms and conditions at any time for any reason.
